76-77 \u2013 for diploma}<\/p>\n<p class=\"has-text-align-center\" style=\"text-align: left;\"><strong>PART VIII<\/strong><br \/>\n<strong>Foreigners in the system of higher education and science<\/strong><\/p>\n<p style=\"text-align: left;\"><strong>Art. 323.<\/strong><\/p>\n<ol style=\"text-align: left;\">\n<li>Foreigners may undertake and complete studies, education at doctoral schools, post-graduate studies, specialist education and other forms of education, and participate in scientific activity or teaching, on the basis of the following:\n<p>1) international agreements, pursuant to the rules specified therein;<br \/>\n2) agreements concluded with foreign entities by higher education institutions, pursuant to the rules specified therein;<br \/>\n3) decision of the minister;<br \/>\n4) the decision of the director Polish National Agency for Academic Exchange with regard to its scholarship holders;<br \/>\n5) the decision of the director of the National Science Centre to allocate financial resources for basic research in the form of a research project, internship or scholarship, selected for funding through competition;<br \/>\n6) the administrative decision of the rector, the director of the Institute of Polish Academy of Sciences, the director of a research institute or the director of an international institute.<\/li>\n<li>The minister may grant a foreigner a scholarship, fund or co-finance the costs of educational services and a lump sum for the costs of travel, living and accommodation. The financial resources are paid through Polish National Agency for Academic Exchange.<\/li>\n<li>The minister may authorise the director of Polish National Agency for Academic Exchange to issue the decisions referred to in sec. 1 point 3.<\/li>\n<\/ol>\n<p style=\"text-align: left;\"><strong>Art. 324.<\/strong><\/p>\n<ol>\n<li style=\"text-align: left;\">A foreigner may be exempt from the fees referred to in Art. 79 sec. 1 points 2, 3 and 5 and Art. 163 sec. 2, pursuant to the rules laid down in an agreement between higher education institutions or an international agreement. A foreigner may also be exempt from these fees on the basis of the following:\n<p>1) an administrative decision of the rector, the director of an institute of Polish Academy of Sciences or the director of a research institute;<br \/>\n2) the decision of the minister or of the director Polish National Agency for Academic Exchange with regard to its scholarship holders;<\/li>\n<li style=\"text-align: left;\">The following persons shall not be charged fees referred to in Art. 79 sec. 1 point 5:\n<p>1) a foreigner- a citizen of the Member State of the European Union, the Swiss Confederation or of the Member State of the European Free Trade Agreement (EFTA) \u2013 the parties to the European Economic Area Agreement as well as members of their family living in the Republic of Poland;<br \/>\n2) a foreigner who has been granted a residence permit or the EU long-term residence permit;<br \/>\n3) a foreigner who has been granted a stay permit in connection with the circumstansces referred to in Art. 159 sec. 1 or Art. 186sec. 1 point 3 or 4 of the Act of 12 December 2013 on Foreigners;<br \/>\n4) a foreigner who has the status of refugee granted in the Republic of Poland or is under temporary protection or subsidiary protection in the Republic of Poland;<br \/>\n5) a foreigner \u2013 a holder of a certificate confirming the knowledge of Polish as a foreign language, referred to in Art. 11a sec. 2 of the Act of 7 October 1999 on the Polish language, at least at C1 language proficiency level;<br \/>\n6) a holder of the Polish Charter or a person who has been issued a decision on the determination of the Polish origin;<br \/>\n7) a foreigner who is a spouse, ascendant or descendant of a citizen of the Republic of Poland, living in the Republic of Poland;<br \/>\n8) a foreigner who has been granted a stay permit in connection with the circumstances referred to in Art. 151 sec. 1 or Art. 151b sec. 1 of the Act of 12 December 2013 on Foreigners, or staying in the Republic of Poland in connection with the use of short-term mobility of a scientist under the conditions set out in Art. 156b sec. 1 of this Act or holding a national visa in order to conduct scientific research or development work.<\/li>\n<li style=\"text-align: left;\">A foreigner other than those referred to in sec. 2 points 2 \u2013 8 may not apply for the maintenance grant referred to in Art. 86 sec. 1 point 1 and student loan, referred to in Art. 98 sec. 1.<\/li>\n<li style=\"text-align: left;\">Family members of the persons referred to in sec. 2 point 1 shall be considered to be the persons mentioned in Art. 2 point 4 of the Act of 14 July 2006 on entering the territory of the Republic of Poland, residence and departure from this territory of nationals of Member States of the European Union and their family members.<\/li>\n<\/ol>\n<\/div>\n            <\/div>\n        <\/div>\n                      \n                            <div class=\"accordion-item\">\n            <H2 class=\"accordion-header\" id=\"flush-headingacc-block_827b01fad960121dd7e0c4628d930f851\">\n            <button class=\"accordion-button collapsed\" type=\"button\" data-bs-toggle=\"collapse\" data-bs-target=\"#flush-collapseacc-block_827b01fad960121dd7e0c4628d930f851\" aria-expanded=\"false\" aria-controls=\"flush-collapseacc-block_827b01fad960121dd7e0c4628d930f851\">\n            Ustawa \u2013 Prawo o szkolnictwie wy\u017cszym i nauce            <\/button>\n            <\/H2>\n            <div id=\"flush-collapseacc-block_827b01fad960121dd7e0c4628d930f851\" class=\"accordion-collapse collapse\" aria-labelledby=\"flush-headingacc-block_827b01fad960121dd7e0c4628d930f851\" data-bs-parent=\"#acc-block_827b01fad960121dd7e0c4628d930f85\">\n            <div class=\"accordion-body\"><p class=\"has-text-align-center\" style=\"text-align: left;\"><strong>POLSKI \u2013\u00a0<\/strong><a href=\"https:\/\/konstytucjadlanauki.gov.pl\/pobierz-ustawe\" target=\"_blank\" rel=\"noreferrer noopener\">ca\u0142y tekst<\/a><br \/>\n{og\u00f3lne informacje nt studiowania zob. Art: 63-67 \u2013 studia i 76-77 \u2013 dyplomy}<\/p>\n<p class=\"has-text-align-center\" style=\"text-align: left;\"><strong>DZIA\u0141 VIII<\/strong><br \/>\n<strong>Cudzoziemcy w systemie szkolnictwa wy\u017cszego i nauki<\/strong><\/p>\n<p style=\"text-align: left;\"><strong>Art. 323.<\/strong>\u00a0[Podstawy prawne kszta\u0142cenia cudzoziemc\u00f3w; przyznawanie cudzoziemcom \u015brodk\u00f3w finansowych na nauk\u0119]<\/p>\n<ol style=\"text-align: left;\">\n<li>Cudzoziemcy mog\u0105 podejmowa\u0107 i odbywa\u0107 studia, kszta\u0142cenie w szko\u0142ach doktorskich, studia podyplomowe, kszta\u0142cenie specjalistyczne i inne formy kszta\u0142cenia oraz uczestniczy\u0107 w prowadzeniu dzia\u0142alno\u015bci naukowej lub w prowadzeniu kszta\u0142cenia, na podstawie:\n<p>1) um\u00f3w mi\u0119dzynarodowych, na zasadach okre\u015blonych w tych umowach;<br \/>\n2) um\u00f3w zawieranych z podmiotami zagranicznymi przez uczelnie, na zasadach okre\u015blonych w tych umowach;<br \/>\n3) decyzji ministra;<br \/>\n4) decyzji dyrektora NAWA w odniesieniu do jej stypendyst\u00f3w;<br \/>\n5) decyzji dyrektora NCN o przyznaniu \u015brodk\u00f3w finansowych na realizacj\u0119 bada\u0144 podstawowych w formie projektu badawczego, sta\u017cu lub stypendium, zakwalifikowanych do finansowania w drodze konkursu;<br \/>\n6) decyzji administracyjnej rektora, dyrektora instytutu PAN, dyrektora instytutu badawczego lub dyrektora instytutu mi\u0119dzynarodowego.<\/li>\n<li>Minister mo\u017ce przyzna\u0107 cudzoziemcowi stypendium, finansowanie lub dofinansowanie do koszt\u00f3w op\u0142at za us\u0142ugi edukacyjne oraz rycza\u0142t na koszty podr\u00f3\u017cy, utrzymania i zakwaterowania. \u015arodki finansowe s\u0105 wyp\u0142acane za po\u015brednictwem NAWA.<\/li>\n<li>Minister mo\u017ce upowa\u017cni\u0107 dyrektora NAWA do wydawania decyzji, o kt\u00f3rych mowa w ust. 1 pkt 3.<\/li>\n<\/ol>\n<p style=\"text-align: left;\"><strong>Art. 324.\u00a0<\/strong>[Zwolnienie cudzoziemca z op\u0142at za studia]<\/p>\n<ol>\n<li style=\"text-align: left;\">Cudzoziemiec mo\u017ce by\u0107 zwolniony z op\u0142at, o kt\u00f3rych mowa w art. 79 ust. 1 pkt 2, 3 i 5 oraz art. 163 ust. 2, na zasadach okre\u015blonych w umowie mi\u0119dzy uczelniami albo umowie mi\u0119dzynarodowej. Zwolnienie cudzoziemca z tych op\u0142at mo\u017ce nast\u0105pi\u0107 r\u00f3wnie\u017c na podstawie :\n<p>1) decyzji administracyjnej rektora, dyrektora instytutu PAN lub dyrektora instytutu badawczego;<br \/>\n2) decyzji ministra lub decyzji dyrektora NAWA w odniesieniu do jej stypendyst\u00f3w.<\/li>\n<li style=\"text-align: left;\">Op\u0142at, o kt\u00f3rych mowa w art. 79 ust. 1 pkt 5, nie pobiera si\u0119 od:\n<p>1) cudzoziemca \u2013 obywatela pa\u0144stwa cz\u0142onkowskiego Unii Europejskiej, Konfederacji Szwajcarskiej lub pa\u0144stwa cz\u0142onkowskiego Europejskiego Porozumienia o Wolnym Handlu (EFTA) \u2013 strony umowy o Europejskim Obszarze Gospodarczym i cz\u0142onk\u00f3w ich rodzin, mieszkaj\u0105cych na terytorium Rzeczypospolitej Polskiej;<br \/>\n2) cudzoziemca, kt\u00f3remu udzielono zezwolenia na pobyt sta\u0142y, lub rezydenta d\u0142ugoterminowego Unii Europejskiej;<br \/>\n3) cudzoziemca, kt\u00f3remu udzielono zezwolenia na pobyt czasowy w zwi\u0105zku z okoliczno\u015bciami, o kt\u00f3rych mowa w art. 159 ust. 1 lub art. 186 ust. 1 pkt 3 lub 4 ustawy z dnia 12 grudnia 2013 r. o cudzoziemcach (Dz. U. z 2017 r. poz. 2206 i 2282 oraz z 2018 r. poz. 107, 138 i 771);<br \/>\n4) cudzoziemca, kt\u00f3ry posiada status uchod\u017acy nadany w Rzeczypospolitej Polskiej albo korzysta z ochrony czasowej albo ochrony uzupe\u0142niaj\u0105cej na terytorium Rzeczypospolitej Polskiej;<br \/>\n5) cudzoziemca \u2013 posiadacza certyfikatu po\u015bwiadczaj\u0105cego znajomo\u015b\u0107 j\u0119zyka polskiego jako obcego, o kt\u00f3rym mowa w art. 11a ust. 2ustawy z dnia 7 pa\u017adziernika 1999 r. o j\u0119zyku polskim (Dz. U. z 2018 r. poz. 931), co najmniej na poziomie bieg\u0142o\u015bci j\u0119zykowej C1;<br \/>\n6) posiadacza Karty Polaka lub osoby, kt\u00f3rej wydano decyzj\u0119 w sprawie stwierdzenia polskiego pochodzenia;<br \/>\n7) cudzoziemca b\u0119d\u0105cego ma\u0142\u017conkiem, wst\u0119pnym lub zst\u0119pnym obywatela Rzeczypospolitej Polskiej, mieszkaj\u0105cym na terytorium Rzeczypospolitej Polskiej;<br \/>\n8) cudzoziemca, kt\u00f3remu udzielono zezwolenia na pobyt czasowy w zwi\u0105zku z okoliczno\u015bciami, o kt\u00f3rych mowa w art. 151 ust. 1lub art. 151b ust. 1ustawy z dnia 12 grudnia 2013 r. o cudzoziemcach, lub przebywaj\u0105cego na terytorium Rzeczypospolitej Polskiej w zwi\u0105zku z korzystaniem z mobilno\u015bci kr\u00f3tkoterminowej naukowca na warunkach okre\u015blonych w art. 156b ust. 1 tej ustawy lub posiadaj\u0105cego wiz\u0119 krajow\u0105 w celu prowadzenia bada\u0144 naukowych lub prac rozwojowych.<\/li>\n<li style=\"text-align: left;\">Cudzoziemiec niewymieniony w ust. 2 pkt 2-8 nie mo\u017ce ubiega\u0107 si\u0119 o stypendium socjalne, o kt\u00f3rym mowa w art. 86 ust. 1 pkt 1, oraz o kredyt studencki, o kt\u00f3rym mowa w art. 98 ust. 1.<\/li>\n<li style=\"text-align: left;\">Za cz\u0142onk\u00f3w rodzin os\u00f3b, o kt\u00f3rych mowa w ust. 2 pkt 1, uwa\u017ca si\u0119 osoby wymienione w art. 2 pkt 4ustawy z dnia 14 lipca 2006 r. o wje\u017adzie na terytorium Rzeczypospolitej Polskiej, pobycie oraz wyje\u017adzie z tego terytorium obywateli pa\u0144stw cz\u0142onkowskich Unii Europejskiej i cz\u0142onk\u00f3w ich rodzin (Dz.
